Issues regarding Teaching Artists and
Liability Insurance
The Commission has recently received requests for information regarding
liability insurance and whose responsibility it is to have that
insurance when you are a teaching artist working as an artist in
residence in the schools. Here you will find a brief explanation
from a school district risk management office, contractors refer
to the artist in residence. We hope you find this information useful as
you continue to plan and participate in artist in residence programs.
The Arizona Trust is an organization that
allows school districts to pair up to provide liability insurance at a
group rate. The Trust provides coverage to all but four school districts
in the state. As sound risk management practice schools require its
contractors to provide insurance for the contractor's acts or omissions.
Typically, contractors are paid a fee to perform a service. Also, it is
typical that contractors have control over the means and methods of how
they perform those services. Therefore, contractors are responsible for
their services, including the financial consequences of failing to
perform the services correctly. Contractors buy insurance for the direct
benefit of the contractor and indirect benefit of the school district.
Although it is good business practice for a contractor to buy insurance,
it is not mandatory in all cases. If the district is willing to take the
consequences (financial and otherwise) of a contractor's negligent acts
and omissions, it can. The arrangement must be memorialized, via
contract, prior to the loss. Whether or not to accept responsibility for
a contractor's acts or omissions is a business decision and comes with
risk to the district and its taxpayers.
